The terms and conditions herein shall be read together with and supplementary to the standard terms and conditions of MBF Cards (M'sia) Sdn. Bhd. ("MBFC")'s Card Agreement (“Card Agreement”). In the event of any discrepancy or inconsistency between this agreement and the Card Agreement, the terms of this Agreement shall prevail in so far as applicable to MBF Cards “Free Stay” Program. |

The word “Card(s)” means any credit and/or charge card issued by MBFC. |
|
|
The word “CardMember(s)” means the Principal holder of the Card. |
|
|
The word “Website” refers to www.mbfcards.com |
|
|
TLC Marketing Worldwide Pty Ltd, PO Box 207, North Sydney, NSW, 2059, Australia (TLC) is the administrator and booking agent for this Program, acting on behalf of TLC Marketing Plc. |
|
|
The Promoter refers to MBFC. |
|
|
The words “MBF Cards Free Stay Program” or the “Program” referred to in this Agreement refers to a program made available by MBFC whereby eligible CardMembers will be entitled to redeem one week’s (7 nights) self-catering accommodation in a selection of destinations upon approval of their credit card application (where applicable) and the terms and conditions herein: |

| The Program |
|
|
| 1. | The ‘MBF Cards Free Stay Program’ (“Program”) shall be effective from 11 March 2009 to 31 October 2009 (“Period”) or whilst stock last, both dates inclusive or any other date to be solely determined by MBFC from time to time. |
|
|
| 2. | This Program shall be open to eligible CardMembers who are Principal card holders of either a MasterCard and/or Visa Gold or MasterCard and/or Visa Platinum Card. |
|
|
| 3. | All Card applications are subject to approval and MBFC reserves the right to reject/decline any application without giving any reason whatsoever. |
|
|
| 4. | The Program is complimentary to the CardMember upon the approval of the Card. |
|
|
| 5. | For CardMembers who opt to take up this Program, MBFC will debit the CardMembers Card Account accordingly with the following annual fees upon Card approval: |
|
|
| a) MasterCard and/or Visa Gold – RM450 (2 years annual fee) |
|
|
b) MasterCard and/or Visa Platinum – RM450 (1st year annual fee, 2nd year free annual fee) |
|
|
| 6. | The CardMember may be eligible to a 100% annual fee refund in the event TLC cancels the confirmed bookings and not able to provide similar alternatives. The CardMember shall not be entitled to any annual fee refund if the CardMember instructs TLC to cancel the bookings, no-show on date of travel, fails to confirm reservation offers and failure to comply with the Terms and Conditions of this Program. |
|
| 7. | MBFC’s liability for any losses if any suffered by CardMember arising from this Program is limited to the annual fees paid. |
|
| 8. | Clause 1 to 7 stipulated under 'The Program' Terms & Conditions are governed by and construed in accordance to the laws of Malaysia. The CardMember has read and understood all the terms and conditions specified herein and MBFC reserves the right to change, amend and/or modify any or all terms and conditions stipulated herein from time to time and/or terminate this Program without notice. |
|
| 9. | 'The Program Offer' (Terms & Conditions by TLC) forms part of the MBF Cards Free Stay Program's Terms & Conditions. |
|
| 10. | In the event of any discrepancy between English and Bahasa Malaysia version of these terms and conditions, the English version shall prevail. |
|
| The Program Offer (Terms and Conditions by TLC) |
|
| 1. | This offer is open to all Malaysian residents aged 18 or over for new bookings only. This offer is not available to employees of TLC or agencies appointed by TLC and their immediate families. |
|
| 2. | The Voucher Code entitles the bearer and up to three guests to one week’s (7 nights) holiday in self catering accommodation in a selection of destinations, subject to the chosen destination and dates being available. |
|
|
| 3. | Only one Voucher Code may be used per person, per household and per booking group. (A group is defined as more than one person accompanying the Voucher Code holder). |
|
|
| 4. | The voucher claimant may not claim another Voucher Code. |
|
|
| 5. | The Voucher Code is valid for 12 months from the date the Voucher Code is issued via SMS. |
|
|
| 6. | The accommodation must be booked before the expiry date of the Voucher Code. |
|
|
| 7. | Upon completion of the booking, e-mail confirmation will be sent to you detailing your booking details. This document must be presented by the CardMember when checking-in to the resort. TLC, the Promoter and its authorised agents cannot accept any liability for any failure to present proof of reservation at the resort by the CardMember when checking in, which may result in refusal to accept the reservation. |
|

| 8. | All accommodation is strictly subject to promotional availability. Availability will be very limited during school and public holidays which are considered peak season. |
|
|
| 9. | The accommodation provided is fully furnished and equipped. Meals, transport (including flights, transfers, airport tax) and personal expenses are not included. A limited number of resorts may require a contribution to utility charges for electricity, telephone and/or water. All inclusive fees may be mandatory at some resorts. You will be advised in advance of these requirements, prior to confirming your booking. (See important information in “How To Use” instructions in TLC’s website). |

| 10. | Resorts often have on-site facilities although there is no guarantee these will be available all year round. |
|
|
| 11. | You are responsible for any damage to the apartment during your stay and the resort may ask you for a breakage deposit upon arrival. |
|
|
12. | There will be a mandatory RM500 charge if a booking is cancelled OR amended less than 72 hours from the date of arrival. TLC reserves the right to charge RM500 per booking if the CardMember fails to check in on the chosen date. |
|
|
13. | All passengers must be responsible for purchasing adequate travel insurance before travelling. The Promoter and TLC accept no responsibility for any problems caused by a failure to purchase travel insurance and shall be entirely without liability. |
|
|
14. | To be eligible to use your Voucher Code, you must be over 18 years of age or 21 if travelling to the US. All passengers should ensure they have a valid passport and visa, if necessary, as well as any vaccinations, according to the immigration laws of the destination you wish to travel to. Please check your passport and that all necessary visas are valid before confirming your booking. Some resorts may impose a minimum age requirement. You will be informed at the time of booking. |

|
15. | This offer has no monetary value, is non-transferable, cannot be resold and cannot be used in conjunction with any other promotional offer or redeemed in whole or part for cash. |
|
|
16. | Due to circumstances beyond TLC or the supplier’s control, there may be changes to the organisation of participating resorts or their owners. If this occurs you will be contacted prior to departure and a similar alternative offered. |
|
|
17. | TLC reserves the right to substitute the offer with another of greater or equal value. |
|
|
18. | Prices (if any) and information presented are valid at the time of going to press and could be subject to change. |
|
|
19. | TLC is not responsible for any misrepresentation of the offer (written or verbal) on warranties by anyone/group other than TLC. |
|
|
20. | The ‘How To Use’ instructions in TLC’s website form part of these terms and conditions. |
|
|
21. | TLC, the Promoter and its Authorised Agents have no responsibility for the administration of the resorts and will not accept any complaints regarding the quality or performance thereof. |
|
|
22. | TLC, its agents and distributors do not guarantee the quality and/or availability of the services offered by the resorts and cannot be held liable for any resulting personal loss or damage. |
|
|
23. | TLC reserve the right to withdraw this offer without advance notice in the event of force majeure such as war, earthquakes, disasters, calamities or similar circumstances, in which travel to such destinations is not advisable. |
|
|
24. | Any persons taking advantage of this promotion must do so on complete acceptance of these terms and conditions. |
|
|
25. | TLC reserves the right to vary these terms without notice. |
|
|
